1. Acceptance

By accessing or using the site, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the site. If you use the site for an organization, you represent that you are authorized to bind it.

2. General-audience travel guide

The site provides general destination information and editorial content. It is not a travel agency, tour operator, hotel, restaurant, transportation provider, government agency, emergency service, medical service, or legal adviser. Unless a page expressly states otherwise, we do not own, operate, control, or guarantee the places or services described.

3. Time-sensitive information

Hours, prices, fees, routes, reservations, permits, access rules, conditions, weather, surf, closures, menus, availability, and other details can change without notice. Verify important information directly with the responsible venue, provider, or authority before relying on it.

4. Third-party services and links

The site may link to or embed maps, booking platforms, retailers, social networks, videos, advertisements, and other third-party services. We do not control their content, availability, security, accessibility, privacy, pricing, or performance. Your transaction or interaction is with the third party and is governed by its terms.

5. Advertising and affiliate relationships

The site may display advertising and may earn commissions from qualifying bookings or purchases made through links. These relationships are explained in the Advertising and Affiliate Disclosure. Advertisements and affiliate links do not create a warranty or make us a party to your transaction.

6. Permitted use

You may access and use the site for personal, lawful, non-commercial travel research. You may link to public pages in a way that does not imply sponsorship or affiliation. Any other reproduction, republication, scraping, redistribution, commercial exploitation, or creation of a substitute database requires prior written permission unless allowed by law.

7. Prohibited conduct

You may not:

  • Use the site unlawfully, fraudulently, or to harm another person.
  • Interfere with security, availability, rate limits, or normal operation.
  • Attempt unauthorized access to accounts, systems, data, or source code.
  • Transmit malware, spam, deceptive requests, or automated traffic that burdens the site.
  • Scrape or harvest personal information, or use site content to train a commercial model, without written permission where permission may lawfully be required.
  • Remove attribution or ownership notices, impersonate another person, or misrepresent affiliation.

8. Comments and submissions

If comments or submissions are available, you retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, and distribute it as needed to operate and promote the site. You represent that you have the necessary rights and that the content is lawful and not misleading, defamatory, infringing, invasive, or harmful.

We may moderate, refuse, edit for formatting, or remove submissions, but we do not undertake to monitor all content. Do not submit confidential information.

9. Intellectual property

Site design, original text, graphics, branding, compilations, and other materials are owned by or licensed to Waikiki.info and protected by applicable law. Third-party names, marks, photographs, and materials remain the property of their respective owners. See the Copyright and Takedown Policy.

10. Disclaimer of warranties

To the maximum extent permitted by law, the site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, or non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, Waikiki.info and its contributors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, travel disruption, personal injury, property loss, or costs arising from use of or inability to use the site, reliance on content, or third-party services.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, the provisions apply only to the extent permitted. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Waikiki.info from claims, losses, liabilities, and reasonable costs arising from your unlawful use, your submissions, or your violation of these Terms or another person's rights.

13. Governing law and disputes

Except where consumer law requires otherwise, these Terms are governed by the laws of the State of Hawaii, United States, with venue in the state and federal courts located in Honolulu County, Hawaii, without regard to conflict-of-law rules. Before filing a claim, you agree to send a written description to media@waikiki.info and allow a reasonable opportunity to resolve it informally.
